PESO License Consultant in Ankleshwar - A One Consultants

PESO Services for Ankleshwar GIDC

There is no single “PESO licence.” Which rule set applies is decided by the material, its classification, the quantity held, the storage arrangement and the equipment installed — not by the size of the plot.

Under the Petroleum Rules, 2002, materials are classified by flash point. This is the classification that catches most GIDC chemical and API units:

Petroleum Class A

Below 23°C

Hexane, benzene, toluene, naphtha. The Inflammable Substance Act, 1952 also brings acetone, ethyl alcohol and methyl alcohol under the Petroleum Rules.

Petroleum Class B

23°C to below 65°C

Diesel (HSD), kerosene (SKO) and mineral turpentine. Usually held as utility or captive fuel stock rather than process input.

Petroleum Class C

65°C to below 93°C

Furnace oil and light diesel oil — typically boiler and thermic fluid heater feedstock.

Why classification matters more than the material name. The Petroleum Act defines petroleum as any liquid hydrocarbon or mixture of hydrocarbons, and any inflammable mixture containing a liquid hydrocarbon. Some solvents units assume are covered fall outside that definition; some they assume are exempt do not. Get this wrong and the whole application is built on the wrong licence form.

Beyond the Petroleum Rules, the sets that most often apply here are the SMPV(U) Rules, 2016 for pressure vessels and bulk gas, the Gas Cylinder Rules, 2016 for cylinder storage, and the Explosives Rules, 2008 where regulated explosive products are involved. Electrical equipment in hazardous areas requires separate approval from the Chief Controller of Explosives.

For Gujarat applicants the field office is PESO’s Vadodara Circle Office.

Chemical & Pharma Licensing

Ankleshwar GIDC is one of India’s older chemical estates, and that history creates a specific pattern of licensing problems. Plots have changed hands, plants have been debottlenecked repeatedly, and tankage has been added block by block. The licence in the file often describes a facility that stopped existing some years ago.

The situations we are most often called in on:

  • Capacity expansion. A dyes or intermediates unit adding solvent storage ahead of a new product line, where the licensed quantity no longer covers the intended holding.
  • Legacy drawings. A licence granted years ago whose approved drawing no longer matches the tank farm, the bunding or the plot layout.
  • New site commissioning. Units taking allotment in Panoli, Jhagadia, Valia or Sayakha, where a fresh site licence is required rather than a transfer.
  • Change of ownership. Acquisition of an Ankleshwar plot with existing approvals, where the licences may not travel with the asset.
  • Departmental correspondence. A letter that needs a considered technical reply rather than a holding response.
  • Pressure vessels and gas. Reactors, storage vessels, nitrogen and hydrogen installations brought into scope by the SMPV(U) or Gas Cylinder Rules.

None of these is automatic. A unit two plots away may hold the same solvent at a different quantity and sit in a completely different position.

Hazardous Storage Approval

Storage approval turns on four things assessed together: what the material is, how much is held, how it is stored, and where the storage sits relative to everything around it.

  • Classification. Whether the material falls within the statutory definition, and which class applies.
  • Quantity. Thresholds differ by class and storage mode. Verify current figures against the rules rather than published summaries, which are frequently out of date.
  • Storage mode. Drums, day tanks, above-ground bulk tankage and underground tanks are not treated alike.
  • Site configuration. Distances to protected works, bunding, and how storage sits relative to the boundary and neighbouring plots.

On a mature estate the last of these is genuinely dynamic. Protected works within the prescribed distance of your boundary change as the estate develops, so a position established years ago may no longer hold.

Documents Required

There is no universal checklist. What is required follows from the rule set, the licence form, the material, the quantity, and whether the application is fresh, a renewal, an amendment or a change of constitution.

Commonly involved

  • Company constitution and incorporation documents
  • Authorisation for the person signing
  • GIDC plot allotment letter, lease deed or occupancy proof
  • Site plan, key plan and layout drawing
  • Tank and vessel specifications and test certificates
  • Material identity, classification and quantity particulars
  • Safety and test certificates by a recognised competent person
  • NOC from the District Collector or Police Commissioner, where applicable
  • Existing licence with approved drawing, for renewal or amendment

Where Ankleshwar files lose time

Drawings. Almost always drawings.

A layout prepared when the plot was first developed will not survive scrutiny once a tank farm has been extended, a shed converted, or a neighbouring plot built up. On a mature estate, the surroundings change often.

The second recurring problem is quantity drift: the licensed holding says one figure, the storage on the ground says another, and nobody reconciled the two at the last renewal.

Site & Safety Compliance

PESO has moved to a paperless process, with applications routed through the National Single Window System. PESO’s published document on disposal timelines states that online applications are auto-inwarded four times a day and are to be processed within 21 days. Read that figure for what it is — a departmental processing timeline, not a promise of when your licence arrives. Elapsed time is governed almost entirely by how often the file goes back for clarification.

A practical sequence for an Ankleshwar application: material assessment and classification, licence category identification, document collection, drawing preparation against the current plot and surroundings, competent person certification where the category requires it, collateral NOCs, a cross-check of drawing against form against site, online submission, response to departmental queries, and inspection where applicable.

The cross-check step is the one most often skipped and the one that saves the most time overall.

Inspection & Renewal

Where inspection applies, the outcome turns on whether the site matches the paper. The mismatches that cause trouble are rarely dramatic:

  • A tank or vessel relocated during construction, never reflected in the approved drawing
  • Stored quantities that have crept above the licensed figure
  • Safety fittings replaced with a different make or specification
  • Electrical equipment in a classified area whose approval status nobody has checked
  • Distances on the drawing that do not survive a tape measure
  • A site team that has never seen the drawing filed on their behalf

Renewal timing varies by rule set, and misinformation circulates freely here. A documented example: under the SMPV(U) Rules, licences are granted or renewed for a maximum of three years ending 31st March, and the last date for receipt of a renewal application at the renewing office is 2nd March of the expiry year. Other rule sets carry their own validity periods and cut-off dates — check yours against your licence document rather than assuming the SMPV position applies.

If you are acquiring an Ankleshwar plot, note that under the SMPV(U) Rules a licence cannot be handed from one company to another — the new occupier applies fresh. That belongs in due diligence, not in a post-closing surprise.

What a consultant can and cannot do. We prepare the file, brief your site team and draft replies to departmental observations. We have no role in how an inspection is conducted and no influence over its outcome. A One Consultant is a private consultancy — not a government body, and not appointed or authorised by one. Our practice does not extend to GPCB, CPCB or Drug Department matters.

Support for GIDC Units

We have worked as industrial licensing consultants for 25 years, from an office at GIDC Char Rasta in Vapi — close enough to the South Gujarat chemical belt to attend Ankleshwar sites without turning every visit into an expedition. Our client list includes Sun Pharma, Aarti Industries, Meghmani Organics, Polycab, Hindalco, Alok Industries, Zentiva and Jesons Industries.

What we do

  • Requirement assessment and licence category identification
  • Drawing preparation and approval of drawings from the department
  • Fresh licences, renewals, amendments, transfers and change of constitution
  • Competent person certificate coordination
  • NOC coordination with the District Collector or Police Commissioner
  • Replies to departmental correspondence
  • Inspection preparation and site-versus-drawing reconciliation

How we work

Assessment before paperwork. The first deliverable is a written view on what applies to your site and why. If a consultant asks for documents before asking for your material list and flash points, that ordering is backwards.

With your site team. Your project engineer knows things about the installation that never reach a document.

Honest scope. We do not guarantee approval, cannot accelerate a departmental decision, and do not handle GPCB, CPCB or Drug Department matters.

FAQs

Does every chemical unit in Ankleshwar need a PESO licence?

No. The test is whether your materials and installations fall within the statutory definitions and applicable rules. Under the Petroleum Act the definition turns on whether the substance is a liquid hydrocarbon or an inflammable mixture containing one, with further classification by flash point. Some solvents in common use across the estate fall outside that definition.

Which PESO rules are most relevant to Ankleshwar GIDC units?

Most commonly the Petroleum Rules, 2002 for solvent and fuel storage; the SMPV(U) Rules, 2016 for pressure vessels and bulk gas; and the Gas Cylinder Rules, 2016 for cylinder storage. The Explosives Rules, 2008 apply where regulated explosive products are involved.

What documents are required for a PESO application?

There is no universal list. Most applications involve company constitution documents, plot allotment or lease papers, site and layout drawings, tank or vessel specifications, material and quantity particulars, competent person certificates, applicable NOCs, and for renewals the existing licence with its approved drawing.

How long does a PESO licence application take?

PESO's published timeline document states that online applications, filed through the National Single Window System, are auto-inwarded four times a day and processed within 21 days. That is a departmental processing timeline rather than a guaranteed outcome date.

Is a site inspection required for every application?

No. Whether a site inspection or verification applies, and at what stage, depends on the licence category and the nature of the installation. Where it does apply, the main risk is inconsistency between the submitted drawings and the actual site.

When should I start the renewal process?

Earlier than the expiry date suggests, because renewal cut-offs can fall well before expiry. Under the SMPV(U) Rules, licences run for a maximum of three years ending 31st March with the renewal application due at the renewing office by 2nd March of the expiry year.

We are buying a plot in Ankleshwar that already has a licence. Does it transfer?

Not automatically, and under the SMPV(U) Rules a licence cannot be transferred from one company to another at all. The new occupier must apply for a fresh licence. Treat existing approvals as a due diligence item.

Do you attend the site, or is this handled remotely?

Drawing and inspection work needs someone on the plot. Our office is at GIDC Char Rasta in Vapi and we attend sites across the South Gujarat belt. Initial requirement assessments can usually be done from your material list and existing licence papers.
