Gas Cylinder Licensing Overview

The Gas Cylinder Rules, 2016 replaced the 2004 rules and govern the field broadly. The activities they reach include:

  • Filling. Charging cylinders with compressed or liquefied gas, whether for sale or own use.
  • Possession and storage. Holding cylinders beyond the applicable limits, including at manufacturing sites that only consume gas.
  • Import. Bringing cylinders or filled cylinders into the country.
  • Transport. Movement of cylinders, with its own requirements.
  • Manufacture and testing. Approvals relating to cylinders, valves and their periodic testing.

Consumption is not exemption. A plant that never fills or sells a cylinder can still require approval based on what it holds. Possession and storage are separately addressed in the rules, and the yard inventory is the relevant question.

Where bulk gas is stored in vessels rather than cylinders, the applicable framework is the SMPV(U) Rules, 2016 instead. Sites frequently hold both, which means two rule sets, two applications and two renewal dates.

Who Needs Approval

Gas businesses

  • Industrial gas filling plants
  • Medical oxygen filling and supply
  • LPG bottling and distribution
  • Cylinder testing and requalification stations
  • Gas distributors and dealers holding stock

Industrial users

  • Chemical and pharma plants holding mixed cylinder inventories
  • Engineering and fabrication units with dissolved acetylene and oxygen
  • Laboratories and quality control facilities holding speciality gases
  • Food processing sites using carbon dioxide or nitrogen
  • Textile and processing units with fuel gas cylinders

Applicability depends on the gas, the number and size of cylinders held, whether they are full or empty, and the storage arrangement. Flammable, toxic and inert gases are not treated alike, and a single yard holding several categories needs assessing as a whole rather than gas by gas.

On published cylinder limits. Numbers circulate widely and are frequently drawn from the superseded 2004 rules. Verify any threshold against the Gas Cylinder Rules, 2016 for your specific gas and cylinder type before relying on it.

Storage & Safety Requirements

Cylinder storage requirements concentrate on segregation, security and the condition of the storage area itself.

  • Segregation by category. Flammable, oxidising, toxic and inert gases separated appropriately, and full segregated from empty.
  • Storage structure. Ventilation, roofing, flooring and protection from direct heat.
  • Restraint. Cylinders secured upright against falling.
  • Distances. From the storage area to protected works, boundaries and ignition sources, driven by gas and quantity.
  • Fire protection. Provisions appropriate to the gases held and accessible in practice.
  • Electrical fittings. Suitable for the area classification where flammable gases are stored.
  • Cylinder condition. Valid periodic test status, valve protection and legible markings.

The commonest practical failure is not the structure but the discipline: full and empty mixed, cylinders lying down, and a yard holding more than the licence contemplates because deliveries arrived before consumption caught up.

Documents & Application

PESO has moved to a paperless process, with applications routed through the National Single Window System. PESO’s published document on disposal timelines states that online applications are auto-inwarded four times a day and are to be processed within 21 days. Read that figure for what it is — a departmental processing timeline, not a promise of when your licence arrives. Elapsed time is governed almost entirely by how often the file goes back for clarification.

  • Company constitution and incorporation documents, with signatory authorisation
  • Ownership, lease or plot allotment documents
  • Site plan and storage area layout drawing showing distances
  • Details of gases, cylinder types, sizes and maximum quantities to be held
  • Storage structure construction details and ventilation arrangements
  • Fire protection arrangements
  • Electrical area classification, where flammable gases are involved
  • For filling operations: plant layout, compressor and pumping details, and testing arrangements
  • Cylinder test and requalification records, where applicable
  • Existing licence with approved drawing, for renewal or amendment

For a filling plant the application is substantially more involved than for storage alone, since the process equipment, testing arrangements and cylinder handling all form part of the assessment.

Inspection & Compliance

Cylinder inspections tend to be practical: what is actually in the yard, in what condition, and does it match the licence.

  • A tank or vessel relocated during construction, never reflected in the approved drawing
  • Stored quantities that have crept above the licensed figure
  • Safety fittings replaced with a different make or specification
  • Electrical equipment in a classified area whose approval status nobody has checked
  • Distances on the drawing that do not survive a tape measure
  • A site team that has never seen the drawing filed on their behalf

Add the cylinder-specific checks: segregation as approved, quantities within the licensed holding, cylinders within their test validity, and restraint and valve protection in place. These are operational disciplines rather than construction items, which means they can drift between inspections without anyone noticing.

What a consultant can and cannot do. We prepare the file, brief your site team and draft replies to departmental observations. We have no role in how an inspection is conducted and no influence over its outcome. A One Consultant is a private consultancy — not a government body, and not appointed or authorised by one. Our practice does not extend to GPCB, CPCB or Drug Department matters.

Renewal & Amendments

Validity periods and renewal cut-offs are set by the applicable rules and differ by licence type — read them from your licence document rather than assuming a general period. For comparison, the SMPV(U) Rules run to a maximum of three years ending 31st March with a 2nd March cut-off for renewal applications; the gas cylinder position is governed by its own rules.

Amendment becomes relevant when the gases held change, quantities increase, the storage area is relocated or modified, filling capacity changes, or the company name, constitution or occupancy changes.

A practical note for growing sites: cylinder inventories increase incrementally, so the licensed holding is often overtaken quietly rather than by a single decision. Reviewing the yard against the licence annually is worth more than reviewing it at renewal.

Gujarat Industrial Support

Gas cylinder work in Gujarat divides between gas businesses and industrial users. Filling plants, distributors and testing stations cluster around the major industrial centres — Ahmedabad, Vadodara, Surat and the Sachin and Hazira belt. Industrial users are everywhere manufacturing is, with the chemical and pharma estates of Ankleshwar, Panoli, Vapi and Nandesari holding the most varied inventories.

Sites holding both cylinders and bulk vessels need both frameworks addressed. We assess them together rather than as separate exercises, even though they are filed separately.

Our office is at GIDC Char Rasta in Vapi. For Gujarat applicants the PESO field office is the Vadodara Circle Office.

FAQs

Do we need a licence if we only use cylinders, not fill them?

Possibly. The Gas Cylinder Rules, 2016 address possession and storage separately from filling, so a plant that only consumes gas can still require approval depending on the gases held, the quantities and the storage arrangement.

Which rules apply — Gas Cylinder Rules or SMPV?

Cylinders fall under the Gas Cylinder Rules, 2016; bulk gas stored in vessels falls under the SMPV(U) Rules, 2016. Many sites hold both, which means two separate applications with separate drawings and renewal dates.

Are the 2004 Gas Cylinder Rules still current?

No. The Gas Cylinder Rules, 2016 are the current instrument. Limits and requirements quoted from the 2004 rules still circulate widely online and should not be relied on.

How many cylinders can we store without a licence?

Thresholds depend on the gas, the cylinder type and the storage arrangement, and they differ between categories. Verify the current position against the 2016 rules for your specific case rather than relying on a general figure.

What are the main storage requirements?

Segregation by gas category and between full and empty, secure upright restraint, adequate ventilation, protection from heat, appropriate distances to protected works and ignition sources, suitable electrical fittings where flammable gases are stored, and cylinders within their test validity.

Do cylinders need periodic testing?

Cylinders are subject to periodic testing and requalification requirements, and holding cylinders beyond their test validity is a compliance issue that inspections examine. Testing records should be retained and current.

Is a filling plant licence different from a storage licence?

Yes, and substantially more involved. A filling application covers the process equipment, compressor and pumping arrangements, cylinder handling and testing provisions in addition to the storage itself.

Our cylinder inventory has grown. Does the licence still cover us?

Worth checking. Inventories grow incrementally rather than by decision, so licensed holdings are commonly overtaken without anyone noticing. If the yard exceeds the licensed quantity, the route is an amendment.
