Explosive License Consultant in Gujarat - A One Consultants

Who Needs an Explosives Licence

The Explosives Rules, 2008 attach the licence to the activity. A business may need one, several, or none:

  • Possession and use. Holding explosives for use — typically quarrying, mining, demolition and certain infrastructure work.
  • Storage. Keeping explosives in a magazine or approved storage structure, whether for own use or for supply.
  • Sale. Dealing in explosives, including retail of fireworks where the rules apply.
  • Transport. Moving explosives by road or rail, which carries its own authorisation and vehicle requirements.
  • Manufacture. Producing explosives or explosive articles, subject to the most demanding requirements in the framework.
  • Import. Bringing explosives into the country, with separate procedural requirements.

Related materials sit under their own rules rather than the Explosives Rules — ammonium nitrate under the Ammonium Nitrate Rules, 2012, and calcium carbide under the Calcium Carbide Rules, 1987. Businesses handling these sometimes assume an explosives licence covers them, which it does not.

Classification comes first. Whether a material is an explosive within the meaning of the Act is a legal question, not a commercial description. Getting this wrong at the outset means applying under the wrong framework entirely.

Explosive Storage & Magazine Approval

Storage is where most explosives applications concentrate, and where site planning matters most. A magazine is not a shed with a lock — it is a defined structure whose construction, location and surroundings are all part of the approval.

What the department examines:

  • Location relative to protected works. Distances measured to defined features, driven by the category and quantity of explosive held.
  • Construction of the magazine. Materials, thickness, roof, doors, ventilation and lightning protection appropriate to the category.
  • Mounding and separation. Where required by the quantity and type stored.
  • Security arrangements. Access control, fencing, lighting and custody of keys.
  • Quantity limits. The approved holding, which the site must not exceed in practice.

Distances and construction requirements vary by explosive category and quantity, so they cannot be stated as universal figures. They are determined against the rules for your specific case, and this is work to do before construction rather than after.

Required Documents

Explosives applications are documentation-heavy, and the department’s tolerance for gaps is low.

Applicant and site

  • Constitution and incorporation documents
  • Authorisation for the signatory
  • Land ownership or lease documents
  • Site plan and key plan showing surrounding protected works
  • Magazine construction drawings and specifications

Approvals and declarations

  • NOC from the District Collector or Police Commissioner, as applicable
  • Antecedent and character verification of the applicant, where required
  • Details of category and quantity to be held
  • Security and custody arrangements
  • Existing licence and approved drawing, for renewal or amendment

The collateral approvals, particularly the District Authority NOC, frequently take longer than the application itself. They belong at the start of the schedule, not the middle.

Safety & Site Requirements

Beyond the physical structure, the department looks at how the site is run:

  • Custody and record-keeping. Registers of receipt, issue and balance, maintained currently rather than reconstructed.
  • Authorised persons. Who may access the magazine, and how that is controlled.
  • Fire protection. Arrangements appropriate to the category stored and actually reachable.
  • Lightning protection. Installed and, where applicable, tested with records retained.
  • Housekeeping and prohibited items. Conditions inside and around the magazine.
  • Transport arrangements. Vehicles, escorts and documentation where explosives are moved.

A licence carries conditions, and those conditions are what an inspection tests. A well-built magazine with an out-of-date register is still a compliance problem.

PESO Inspection

Inspection in the explosives framework is more searching than in most others, and the site is examined against both the drawing and the licence conditions.

  • A tank or vessel relocated during construction, never reflected in the approved drawing
  • Stored quantities that have crept above the licensed figure
  • Safety fittings replaced with a different make or specification
  • Electrical equipment in a classified area whose approval status nobody has checked
  • Distances on the drawing that do not survive a tape measure
  • A site team that has never seen the drawing filed on their behalf

Preparation means checking the magazine against its approved drawing, verifying that the holding does not exceed the approved quantity, and having registers, test records and authorisation lists current and available.

What a consultant can and cannot do. We prepare the file, brief your site team and draft replies to departmental observations. We have no role in how an inspection is conducted and no influence over its outcome. A One Consultant is a private consultancy — not a government body, and not appointed or authorised by one. Our practice does not extend to GPCB, CPCB or Drug Department matters.

Renewal/Amendment

Validity periods and renewal cut-offs are set by the applicable rules and differ between licence types, so check your licence document rather than assuming a general period applies. Start earlier than the expiry date suggests: where a collateral NOC has to be refreshed, the lead time sits outside your control.

Amendment becomes relevant when:

  • The category or quantity of explosive held changes
  • The magazine is modified, extended or relocated
  • Surrounding development alters the distance position
  • Company name, constitution or occupancy changes
  • Authorised persons or custody arrangements change materially

Industrial Locations We Cover

Explosives licensing is less clustered than chemical licensing, since it follows quarrying, infrastructure and specific manufacturing rather than an estate. We work across Gujarat, with the practical reach of our Vapi office covering the southern and central belt most readily — Vapi, Valsad, Surat, Bharuch, Ankleshwar, Vadodara and the Ahmedabad region.

For Gujarat applicants the relevant PESO field office is the Vadodara Circle Office, headed by a Joint Chief Controller of Explosives.

A One Consultant has worked on explosive, solvent and industrial licensing since 1999. We prepare and file; we do not approve, and we have no influence over departmental decisions.

Explosive License FAQs

Who needs an explosive licence in Gujarat?

The licence follows the activity rather than the industry. Possession and use, storage, sale, transport, manufacture and import are each separately licensed under the Explosives Rules, 2008. Quarrying and infrastructure contractors, magazine operators, fireworks dealers and transporters are the most common applicants.

Is a separate licence needed for storage and for use?

Generally yes — they are distinct activities under the rules. A business that both holds and uses explosives will usually need to address both, and a business that also moves them will need transport authorisation as well.

What are the safety distances for a magazine?

They are determined by the category and quantity of explosive stored, measured to protected works as defined in the rules, so no single figure applies. Distances must be established against the rules for your specific case before construction, not after.

Does an explosive licence cover ammonium nitrate?

No. Ammonium nitrate is regulated under the Ammonium Nitrate Rules, 2012, which is a separate framework. Calcium carbide similarly falls under the Calcium Carbide Rules, 1987. Assuming an explosives licence covers these is a common and consequential error.

How long does an explosive licence application take?

PESO’s published timeline states that online applications are processed within 21 days. In explosives matters, however, the practical schedule is usually driven by collateral approvals such as the District Authority NOC, which sit outside that timeline.

Can an explosive licence be transferred if the business is sold?

Do not assume so. Changes in the licence holder, constitution or occupancy generally require a formal application rather than an administrative update, and the position differs between rule sets. Treat existing licences as something to verify during due diligence.

What happens if we store more than the approved quantity?

The approved holding is a licence condition, and exceeding it is a compliance failure regardless of whether the magazine could physically accommodate more. If your requirement has grown, the route is an amendment, not an operational decision.

Can you help if we have received a departmental query?

Yes. Preparing a considered technical reply, supported by the correct documentation, is often the difference between a query that closes and one that escalates. Send the correspondence along with your licence and approved drawing.
